LWJ CLIENT SERVICE AGREEMENT

Client Terms & Expectations

1. Confidentiality & Non-Disclosure

All strategies, tools, written materials, templates, communication, and consulting provided by LWJ Productions and Recruiting Consulting (dba. LWJ College Fit Consulting) are confidential and proprietary. Clients may not share, replicate, distribute, or reuse any materials, unless explicitly labeled as free-to-share. This includes text, visuals, planning documents, feedback notes, strategy calls, and email language. These services are intended only for the use of the athlete and family listed at the time of registration.

2. Intellectual Property Ownership

All materials, documents, strategies, graphics, and educational content are the exclusive intellectual property of  LWJ College Fit Consulting. No ownership is transferred at any point. Clients are granted a limited, revocable right to use LWJ content for personal recruiting purposes only, and only during the active subscription period. This includes all original or derivative materials.

3. Feedback Use

LWJ College Fit Consulting may use any feedback, suggestions, or input shared during services to improve future documents, systems, or processes. Clients agree that LWJ retains ownership of these resulting improvements and waive any claims to compensation or creative rights.

4. Dispute Resolution & Legal Liability

Any concerns must be submitted in writing to LWJ via email. LWJ agrees to a 30-day good faith resolution period. If unresolved, disputes will be addressed through binding arbitration in the state of Montana. Clients agree not to pursue litigation against LWJ, as services are offered with fully disclosed limitations and outcomes are highly individualized. LWJ does not guarantee specific recruiting results and declines all liability related to performance, college interest, or scholarship outcomes.

5. Payment Terms

Billing Cycle

Invoices are generated on the same calendar date each month, beginning on the date service starts. Payment is processed automatically on the invoice date. It is the client's responsibility to ensure their payment method is on file (Wave App) is current and available before each billing date. It is the client's responsibility to track and prepare for upcoming payments. LWJ does not issue payment reminders.

Invoice Date

To change an invoice date must be submitted in writing via email no fewer than 5 days before the current invoice date. Date changes are not guaranteed and are made at LWJ's discretion.

Failed Payment

If a charge fails, a $25 late fee is applied for each day the payment remains unresolved. If payment is not resolved within 3 days, service will be suspended until the outstanding balance, including all accrued late fees, is paid in full.

Split Billing

Clients who divide payment across two cards authorize LWJ College Fit Consulting to charge each card for its designated amount on the invoice date. Both charges process simultaneously. A failed charge on either card follows the same failed payment process above.

New or Additional Services

Any new or additional services will be communicated in writing no fewer than 7 days before the invoice date. Written approval is required within 2 days of that notification. If written approval is not received within that window, the service will not be added until the following billing cycle. It is the client's responsibility to respond within the stated timeline. LWJ is not responsible for delays resulting from late or missing client approval.

Cancellation

Written notice of cancellation is required no fewer than 30 days before the next invoice date and must be submitted via email to LWJ College Fit Consulting at the contact address on file. It is the client's responsibility to submit notice within this window. Once an invoice is generated, that amount is owed in full. Service continues through the end of the current billing cycle following confirmed cancellation. LWJ does not offer refunds.

Service Suspension

LWJ College Fit Consulting reserves the right to suspend service if payment is not resolved within 3 days of the invoice date. Service will remain suspended until the full outstanding balance, including all accrued late fees, is paid. Suspension does not void the client's payment obligation.

 

Service Termination by LWJ

LWJ College Fit Consulting reserves the right to terminate service at its discretion under the following conditions:

  • Continued or recurring billing issues

  • Violation of confidentiality or intellectual property terms

  • Breach confirmed by direct evidence, including screenshots, file transfers, forwarded communications, or unauthorized platform access

Termination under these conditions does not entitle the client to a refund of amounts already paid. Any outstanding balance at the time of termination remains owed in full.

6. No Guarantee & No Refunds

Recruiting success depends on athlete effort, skill level, timing, and college needs. LWJ provides support but cannot  and does not promise specific outcomes. All payments are final and non-refundable. LWJ waives any responsibility for perceived results, lost opportunities, or unmet expectations.

7. Platform Access & Technology Use

Productive Recruit and other tools provided during service are third-party platforms. LWJ is not affiliated with these companies and assumes no liability for their functionality or policies. Platform access is a benefit of active LWJ subscription and will be revoked upon cancellation. Clients may not copy, retain, or share any platform-generated materials once access is removed.

8. Client Privacy

All client and athlete personal data: emails, academic records, phone numbers, home address, etc., will be kept confidential and will not be sold, shared, or used outside LWJ's internal systems unless legally required.

9. Digital Use Boundaries

Only the registered athlete and parent(s)/guardian(s) may access LWJ documents, feedback, and services. 

Acknowledgement & Agreement

By participating in any LWJ College Fit Consulting service or subscription, you agree to the following:

  1. Legal guardian & athlete have read and understand the terms outlined above.

  2. Legal guardian & athlete agree to use all LWJ content solely for your family’s recruiting journey.

  3. Legal guardian & athlete accept that no refunds will be issued and that results vary.

  4. Legal guardian & athlete agree not to share, replicate, or reuse LWJ content in any public or business setting.

  5. Legal guardian & athlete understand that payment, access, and communication terms apply during your subscription and that misuse may result in removal.

  6. Legal guardian & athlete understand that LWJ services are provided in good faith but make no guarantees of outcomes.

  7. Legal guardian & athlete agree to resolve any disputes via email and binding arbitration, not litigation.
